Unvell LLC / Legal
Terms and Conditions
Effective date:
Published by Unvell LLC, a Florida limited liability company.
1. Scope, Definitions and Acceptance
These Terms and Conditions (“Transaction Terms”) govern purchases of physical clothing through Unvell LLC, optional item buybacks, proceeds, payouts, custody, shipping and refunds. “Unvell,” “we,” “us” and “our” mean Unvell LLC, a Florida limited liability company. These Transaction Terms incorporate our Terms of Service (“Service Terms”), including eligibility, acceptable use, liability and dispute provisions.
By affirmatively accepting these Transaction Terms through the process presented before purchase, you agree to them and the applicable order disclosures. These Transaction Terms control a conflict concerning a commercial transaction. Mandatory consumer rights prevail over an inconsistent provision.
A “Pack” is an offer for one randomly selected physical clothing item from the eligible inventory for the selected pack and fit size, unless the offer expressly states a different quantity. An “Allocated Item” is the specific unit assigned and recorded for an accepted order. “Keep” is your confirmed election to retain that item for shipment. A “Buyback” is a separate sale of the Allocated Item back to Unvell for an accepted dollar offer. “Eligible Proceeds” are earned buyback amounts available for use or payout after the applicable disclosed checks.
A “business day” is Monday through Friday, excluding United States federal holidays. An offer's displayed expiration time and time zone govern its deadline.
2. Merchandise, Condition and Sizing
Vintage and previously owned garments may show age, fading, wear, print variations and other disclosed characteristics. The condition standard stated for a pack and any material item-specific description apply to your purchase. Normal vintage characteristics do not excuse an undisclosed material defect or a materially inaccurate description.
A fit category may be based on garment measurements rather than the original label. Review the stated sizing method and available measurements. Labels and cuts vary, and we do not guarantee identical fit across brands or eras. We remain responsible for the fit category and material sizing information represented for your purchase.
Featured items and catalog examples do not guarantee a particular design, brand, age, condition characteristic or outcome. Illustrative or simulated images are identified as such and do not establish that an item is eligible live inventory. An allocated item's material description applies to the item you receive.
We do not warrant future resale prices, collector demand or investment performance. This does not limit lawful title obligations, express merchandise representations or warranties that cannot lawfully be excluded.
3. Inventory Selection and Changing Probabilities
Selection depends on the pack, fit size and eligible inventory applicable to the purchase. Selection may be weighted, and eligible items do not necessarily have equal probabilities. Offer ranges and category labels describe the selection information presented in the Platform; they are not independent market appraisals.
UNVELL MAY CHANGE PRICES, PACK CONTENTS, AVAILABLE INVENTORY, OFFER RANGES, SELECTION WEIGHTS AND PROBABILITIES FOR FUTURE PURCHASES. Inventory may be replenished, removed or reclassified, and a pack or size may close. Subject to accurate pre-purchase disclosures and applicable law, ordinary prospective changes do not require individual advance notice.
Displayed probabilities apply to the identified pack, fit size and inventory snapshot. Shared inventory can change as items are allocated, bought back, removed or added. Screenshots, previously viewed information and historical results do not establish the probabilities for a later purchase. The current material selection information will be made available before you accept the purchase. Rounding may cause displayed percentages not to total exactly 100%.
The selection configuration accepted for an order governs that order. We will not retroactively change its probabilities or substitute a later configuration to alter an allocated result. If a material change occurs before completion, we will honor the accepted configuration, present the updated information for your confirmation or cancel and return the payment.
Opening animations, sound, artwork, gestures and reveal speed do not affect the allocated result. Probabilities do not guarantee a particular result or a matching distribution across your individual purchases. Previous results do not entitle you to a compensating outcome or improved future result. Changes in eligible inventory mean successive purchases are not necessarily statistically independent.
TO THE EXTENT PERMITTED BY LAW, UNVELL IS NOT LIABLE SOLELY FOR A PROPERLY DISCLOSED PROSPECTIVE CHANGE, A RESULT PERMITTED BY THE ACCEPTED SELECTION CONFIGURATION, OR A DIFFERENCE BETWEEN AN ITEM'S APPEAL OR LATER RESALE VALUE AND YOUR EXPECTATIONS. THESE CIRCUMSTANCES ALONE DO NOT ENTITLE YOU TO A REFUND, REPLACEMENT SELECTION OR COMPENSATION. This provision does not excuse materially inaccurate disclosures, intentional manipulation contrary to the disclosed process, changes to an accepted purchase or any nonwaivable obligation.
4. Prices, Payment and Order Acceptance
Prices are in United States dollars unless expressly stated otherwise. The pack price, applicable taxes and charges are disclosed before payment authorization. Shipping charges, or the conditions for calculating and paying them later, are disclosed before the pack purchase.
A purchase is a one-time transaction unless you separately accept an expressly disclosed recurring arrangement. You authorize the specific amount and payment method shown at checkout. Saving a payment method does not authorize unsolicited purchases.
Eligible Proceeds may fund a purchase where that option is offered and sufficient funds are available. Partial use or split payment is available only if expressly offered and accurately itemized.
An order is accepted when payment is verified and a specific eligible item is allocated and recorded for you. A receipt or accessible transaction record will be provided. A pending authorization, incomplete checkout or interrupted animation does not by itself establish a completed allocation.
If payment is taken but an order cannot be completed, we will cancel and return the payment promptly under the applicable refund rules. Duplicate allocations and erroneous charges will be investigated and corrected. These acceptance provisions do not postpone a legal shipping or refund deadline measured from receipt of a properly completed order.
5. Ownership and Custody
Upon verified payment and allocation, you obtain title to the identified physical clothing item, subject to lawful cancellation, correction of an invalid transaction or an accepted Buyback. The same unit will not simultaneously be available for another customer and your shipment.
Unvell holds the item pending your election and fulfillment, exercises reasonable care and maintains records identifying the allocated unit. Risk of physical loss remains with Unvell until correct delivery as described in Section 10.
Ownership of an item does not create an ownership interest in Unvell or its other inventory. Account restrictions do not automatically transfer legitimate merchandise rights to Unvell.
6. Keep Election
CONFIRMING KEEP IS A FINAL ELECTION TO RETAIN THE ALLOCATED SHIRT FOR SHIPMENT AND PERMANENTLY ENDS THAT SHIRT'S OPTIONAL BUYBACK AVAILABILITY. You cannot reopen the offer because preferences, plans or market prices change.
Keep does not waive a remedy for non-delivery, materially nonconforming goods, payment errors or another protected circumstance. Provide accurate delivery information promptly and pay any shipping charges properly disclosed for the purchase.
An item cannot be both kept and sold back. Your confirmed election and its time will be recorded. Contact support promptly if you believe an error occurred.
7. Optional Buyback Offers
An eligible item may have a preset dollar Buyback offer established before it enters the eligible pool and displayed after reveal. The offer is specific to that item and may be below, equal to or above the pack price. It is not an independent market valuation or a promise of profit or recovery of your purchase cost.
Unless a different period is clearly disclosed before purchase and displayed with the offer, an unaccepted offer is available for seven calendar days after reveal. The actual expiration time will be displayed. Keep ends the offer earlier. Changes to offers for future purchases do not reduce an outstanding valid offer during its disclosed acceptance period.
When you affirmatively accept an available offer, title transfers back to Unvell, shipment of that item to you is canceled and Unvell owes the accepted amount. The Buyback is final except for verified error, fraud, mutual agreement or applicable law. A Buyback is not a refund of the original pack purchase.
An accepted Buyback is Unvell's payment obligation. It is not contingent on future purchases, resale of the item or Unvell's profitability. Availability of proceeds remains subject to the disclosed verification and review provisions below.
Offer expiration does not automatically sell the item back, forfeit it or surrender your ownership. If an offer expires, we will provide a process for shipment or another lawful resolution.
8. Proceeds, Credits and Additional Purchases
Your account may distinguish pending proceeds, Eligible Proceeds and payout requests. Pending amounts are unavailable until the applicable disclosed payment, verification or legitimate review requirements are satisfied.
Where offered, you may voluntarily use Eligible Proceeds for another purchase or request a cash payout. You are not required to purchase another pack before requesting an otherwise eligible payout.
Promotional credits are separate from earned Buyback proceeds and are subject to the restrictions disclosed for the promotion. A promotional restriction does not convert earned proceeds into nonwithdrawable credit.
An account balance records transaction amounts; it is not a bank account and does not earn interest or carry a promise of deposit insurance. These Transaction Terms do not offer customer-funded cash top-ups, person-to-person payments or transfers between customer accounts.
9. Payouts, Verification and Holds
Payouts are available through the methods offered for your location and account. Use a payout destination you own and are authorized to use. We or our providers may require identity, payment-ownership, fraud-prevention or legally required tax information before processing a payout.
Applicable fees, minimums, limits, material holds and expected processing times are disclosed before confirmation. The request will identify the amount deducted and the amount to be sent. Fees will not be added retroactively to an accepted request.
Unless a different lawful period is clearly disclosed before confirmation, we will initiate an eligible payout within five business days after required checks and any properly disclosed hold are completed. The destination institution may require additional time. We do not guarantee that institution's independent processing time.
We may apply a proportionate temporary hold for a reasonably supported payment reversal, suspected fraud, conflicting ownership claim or legal requirement. Unless disclosure is prohibited, we will identify the general reason, information needed and appropriate review or update process. Insufficient company cash does not extinguish an accepted Buyback obligation or authorize indefinite retention of valid proceeds.
A failed payout does not erase the amount owed. We will restore the amount to an available or appropriately reviewed status, or provide another lawful payment method. Notify support promptly of incorrect destination information; recovery may be unavailable after a transfer correctly executes your authorized instructions. This does not excuse our own error or override applicable payment protections.
Closure, inactivity or a purchasing restriction does not automatically forfeit legitimate proceeds. Unclaimed property will be handled under applicable law.
10. Storage, Shipping and Delivery
For standard U.S. shipping, estimated delivery is 7–10 business days after you confirm Keep and provide complete, accurate delivery information. This estimate includes order processing and carrier transit. Business days exclude weekends and United States federal holidays. Any different delivery estimate will be disclosed before you confirm the order. Delivery estimates are not guarantees; the delay notices and cancellation or refund rights below still apply.
Any arrangement to hold an item or defer shipment requires your affirmative agreement. An unresolved Keep decision, incomplete verification or a payment provider's settlement schedule does not automatically extend an applicable shipping deadline. If no shipment period has been agreed and the federal default period applies, we will ship within 30 days after receipt of a properly completed order or follow the applicable delay-notice, consent and refund requirements.
If we cannot meet the applicable shipment deadline, we will notify you of the delay, provide a revised shipment date and explain your cancellation and refund rights. We will obtain any consent required to continue the order. If you are entitled to cancel or we cannot fulfill the order, we will issue the required full and prompt refund. A buyback offer or store credit will not replace a required refund without your agreement.
We ship the specific item allocated to your order. We will not substitute another item without your consent. If the item becomes unavailable or is lost before delivery and fulfillment cannot be completed, the applicable remedy includes a refund of the purchase price, taxes and refundable shipping charges. An internal valuation or a lower buyback offer does not limit that refund.
Every shipment includes tracking, and we provide the tracking details to you when your order ships. You are responsible for providing complete, accurate delivery information and contacting support about changes before dispatch. We will make reasonable efforts to accommodate timely changes but cannot guarantee interception or rerouting after shipment. Any additional charge for a customer-requested change or redelivery will be disclosed before you authorize it.
Risk of physical loss remains with Unvell until correct delivery to the address or recipient you authorized. Following documented correct delivery, subsequent loss or theft is ordinarily your responsibility, subject to applicable law and evidence of delivery error. Carrier tracking is evidence of delivery and is not conclusive against a supported claim.
If information necessary for shipment remains missing, we will contact you. Where permitted, we may cancel an unshipped order and issue a full refund after at least 30 calendar days' written notice and an opportunity to resolve the issue. We will act sooner when required by law. Title returns to Unvell upon completion of the cancellation and refund; inactivity alone does not transfer ownership.
11. Returns and Refunds
Pack purchases are final for changes of mind based solely on the selected design, personal preference, an anticipated outcome that did not occur or a buyback offer below the purchase price. We do not offer a replacement selection for these reasons. An available buyback is a separate transaction under Section 7.
This final-sale policy does not limit remedies for non-delivery, an incorrect item, a material error in the stated fit category or description, an undisclosed material defect, damage before delivery, a duplicate charge or another circumstance requiring a remedy under applicable law. Confirming Keep or allowing a buyback offer to expire does not waive these rights.
Contact support@unvellpacks.com with your order number, a description of the issue and reasonably available photographs or other evidence. Please report merchandise issues within 14 calendar days after delivery where practical. This requested reporting period facilitates investigation and does not shorten a statutory claim period or automatically bar a valid later claim.
We may request reasonable evidence and return of the item when necessary and permitted by law. Retain the item and packaging where available, and do not wash, alter or materially use an item while a return is being arranged. Do not send a return until support provides instructions. For a verified Unvell fulfillment or description error, we will provide appropriate prepaid return instructions and will not charge an undisclosed restocking fee. The registered-agent address is not a return facility.
We will issue refunds within the applicable legal deadline. For another approved refund requiring a return, we will initiate the refund within seven business days after receiving the required return or confirming that no return is necessary, unless a shorter deadline applies. Your payment provider or bank may require additional time to post the credit.
Refunds ordinarily use the original payment method. Amounts paid from eligible buyback proceeds will be restored as eligible proceeds or refunded by another lawful method preserving their cash value. Promotional credits may be restored in their original promotional form where permitted. A required cash refund will not be converted into compulsory store credit.
12. Errors, Reversals and Payment Disputes
Report suspected errors promptly. We may review payment, selection, allocation and acceptance records and correct verified duplicate, arithmetic or technical errors. An unfavorable result properly selected under the accepted process is not a technical error.
For an obvious price or inventory error discovered before fulfillment, we may seek an agreed correction or cancel and return the payment to the extent permitted by law. We will not automatically replace a confirmed item with a less favorable one or reduce a valid accepted offer.
A payment reversal or reasonably supported fraud concern may result in transaction-specific review and a temporary restriction on the affected amount or merchandise. Recovery or offset will be lawful, documented and connected to the relevant obligation, with appropriate notice and an opportunity to dispute it.
You retain lawful chargeback and unauthorized-payment rights. Neither you nor Unvell may obtain duplicate recovery for the same amount. A good-faith payment dispute alone does not establish fraud.
13. Taxes, Promotions and Additional Charges
Unvell collects and remits sales taxes where required. You are responsible for your own applicable tax and reporting obligations. We do not provide tax advice or represent that every Buyback creates taxable income.
Promotions are governed by their disclosed eligibility, duration and restrictions. Changes to future promotions do not authorize retroactive removal of earned proceeds or accepted offers.
Storage, inactivity, cancellation, maintenance or other additional fees apply only if expressly disclosed before the transaction creating them and permitted by law. A general right to amend terms does not authorize an undisclosed charge.
14. Value Expectations and Liability
A purchase does not guarantee a featured item, particular category, resale opportunity, recovery of the purchase price or profit. Buyback offers are contractual dollar offers, not independent appraisals. Demand and external resale prices may change, and Unvell does not insure future value.
The disclaimers, exclusions and liability limits in Section 12 of the Service Terms apply, subject to their stated exceptions. They do not reduce valid refunds, accepted Buyback payables, Eligible Proceeds, remedies for unfulfilled merchandise or liability that cannot lawfully be limited.
15. Events Beyond Reasonable Control
An event beyond reasonable control, including a natural disaster, carrier disruption, external service outage or government restriction, may delay performance despite reasonable efforts. We will communicate material effects and take reasonable steps to mitigate them.
This provision does not extinguish payment obligations, authorize indefinite retention of funds, extend a mandatory refund deadline or remove a legally required shipping-delay cancellation right. Outstanding merchandise and payment obligations remain subject to lawful resolution.
16. Changes and Contact
The terms accepted for a purchase govern that purchase and its associated valid offer. Later changes apply prospectively following applicable notice and assent requirements. They do not retroactively reduce an accepted offer or payment right.
The amendment, notice, dispute, governing-law and general provisions of the Service Terms apply. Contact support@unvellpacks.com with your order number and requested resolution.
